Synopsis

The lawyer's duty of confidentiality is an ethical duty that the lawyer owes to his clients, both during and after the ongoing process of the lawyer-client relationship. This means that, unlike attorney-client privilege, the duty of confidentiality applies at all times, not just in the face of legal requests for client information (e.g. by a court). According to this duty, lawyers should not disclose information regarding the representation of the client in a positive way. This representation refers to the information that the client shares confidentially with the lawyer, and this information is privileged due to the lawyer-client relationship. In this study, the lawyer's obligation to keep confidentiality will be examined by comparing the legal system of the Republic of Turkey with the legal system of Northern Cyprus.
