Temporary Employment Relationship as a Form of Flexible Employment

Synopsis

The labor market, which is defined as an organization where labor supply and labor demand meet and where wage levels and working conditions are shaped, has been affected by the consequences of globalization. The change in the economic and political paradigm called neoliberalism especially after 1980, the increasing unemployment problem and the changing conditions of competition have made transformations inevitable for the labor market to respond to different market demands. The classical employment relationship has increasingly been replaced by flexible forms of work, also referred to as a-typical employment. With the introduction of flexibility in employment, new opportunities and threats have emerged in the labor market. Flexibility has brought about differentiation in the nature of jobs, types of employment and working hours. Flexibility is detailed in different ways in the labor market as flexibility in production, flexibility in management and flexible employment (flexible working). In this study, the subject is limited within the framework of flexible employment. In this context, "temporary employment relationship", which is one of the flexible employment practices, is evaluated within the framework of the provisions of the Turkish Labor Law legislation.

The temporary employment relationship is essentially regulated in Article 7 of the Labor Law No. 4857. According to the relevant article, the employer may temporarily transfer the employee to another employer, provided that the employee's written consent is obtained. However, with an amendment, the scope of the temporary employment relationship has been expanded and the temporary employment relationship has been applied in two ways. The first is the "temporary employment relationship without a profession". The second is the "temporary employment relationship with a profession". In this context, temporary employment relationship is carried out through Private Employment Agencies. In the study, both application areas of the temporary employment relationship are included and the effects of the temporary employment relationship on the labor market are evaluated in detail.
