Synopsis

Technological advances in banking are increasing rapidly. This situation has expanded the international field of activity of banks. In this sense, banks can open representative offices abroad or establish banks there. Apart from these ways, another alternative is correspondent banking. A correspondent bank is a bank from which a bank receives service while performing banking transactions in another country. Correspondent banking can also be defined as the sale of financial services to another financial institution. Correspondent bank service is used in letter of credit payment method. Here, the correspondent bank acts as an intermediary for the letter of credit payment transaction. This function is called notice banking. Sometimes, the correspondent bank acts as a confirming bank in the letter of credit. The position of correspondent banking in terms of offshore banking is also important. Correspondent banks act as intermediaries in transferring money to offshore banks. In this case, whether the correspondent bank is liable or not has been evaluated in different ways in the judicial decisions. In our opinion, the veil of legal entity should be lifted and the responsibility of the correspondent bank should be taken.
