Synopsis

Regulations are encountered in every country and in any sector in economy. The purpose of regulation is generally the activity of making the production, or the adequate production, of certain goods and services subject to specific rules put by public authorities. Public interest theory and economic regulation theory are the main theories used to explain regulation. Regulations became more prominent in the nineteenth and twentieth centuries. In this respect, Europe, the United States, and the United Kingdom are particularly noteworthy. Concepts such as public interest, as well as reasons said to lead to market failures like information asymmetry, are often cited as justifications for regulation. The insurance sector is also one in which regulations appear. The insurance sector is subject to more intensive regulation compared to many other sectors. For this reason, institutions responsible for establishing, implementing, and monitoring regulations have emerged everywhere. Regulatory practices in the insurance sector may have both positive and negative consequences. These can be observed through Compulsory Motor Liability Insurance in Türkiye. On the one hand, this insurance may lead to negative outcomes such as reduced profit margins for insurance companies and a decline in their competitive power; on the other hand, it may result in positive outcomes such as lower motor insurance premiums and a reduction in the grievances suffered by victims of traffic accidents. The most appropriate approach is to take steps by calculating the potential consequences of regulations and, if necessary, to abolish or revise them in order to eliminate their adverse effects.
