Synopsis
Traditional knowledge refers to living body of knowledge passed down from generation to genaration within a local community. Traditional cultural expressions are also broadly considered part of traditional knowledge. The roots of traditonal knowledge strech back to ancient times and are usually transmitted through informal channels and methods, mostly orally. Traditional knowledge is not protected by conventional intellectual property models. However, efforts to find ways to protect traditional knowledge continue. Work carried out by the World Intellectual Property Organization (WIPO) for over 20 years culminated in the WIPO Treaty on Intellectual Property, Genetic Resources, and Associated Traditional Knowledge, which was adopted on May 24, 2024. In this study addresses the areas of conflict between traditional knowledge and intellectual property law and then examines the provisions of the GRATK Treaty.
