Synopsis

With the acceleration of industrialization, urbanization, and technological developments, the scope of environmental problems has expanded, making it necessary to develop legal and institutional regulations for environmental protection. Environmental law has emerged as an important field of law that develops various regulatory tools to prevent, limit, and control environmental risks in this process. This study aims to examine the regulatory tools used in environmental law in terms of their conceptual framework, legal nature, and forms of application. The study first evaluates the emergence of the need for regulation in environmental law, the emergence of environmental issues as a matter of public policy, and the development of environmental rights. It then explains the concept of regulatory tools and focuses on their legal nature. Within this framework, the main regulatory tools used in environmental law were examined through prohibition, permitting and licensing, notification obligations, environmental obligations, standards, the establishment of protected areas, and environmental impact assessment processes. At the end of the study, it was concluded that regulatory instruments are fundamental mechanisms that ensure the applicability of environmental policies, and that these instruments are not only prohibitive but also have preventive and guiding functions. The effectiveness of regulatory instruments in environmental law becomes more meaningful when assessed in conjunction with elements such as administrative capacity, control mechanisms, and social awareness, in addition to legal regulations. In this respect, regulatory instruments in environmental law retain their importance as one of the fundamental elements of sustainable environmental management.
