Türkiye's Unchanging Immigration Policy Towards Syrian Refugees

Synopsis

States have obligations to open their borders proportionally to their capacity to those who seek refuge en masse, to provide temporary shelter, meet their basic needs, and not to return them forcibly. This study emphasizes that the migration policy towards Syrian refugees -who fled to Turkiye after the outbreak of the civil war in Syria in 2011 and whose number has exceeded 4 million- has remained internally consistent. Turkey granted the Syrians a temporary and pragmatic legal status by placing them under “temporary protection.” Both a decade ago and today, Turkey has based its practices and regulations regarding Syrians on the principle of temporariness. Over the years, while basic rights such as residence, education, and the right to work have been granted to refugees, some Syrians have also been granted citizenship on an exceptional basis. This study examines the legal status of Syrian refugees, the rights granted to them under this status, and Turkiye’s consistent implementation of a migration policy based on temporariness. Although some confusion is occasionally observed in the application of migration policies, it is aimed to determine that the policy of temporariness is permanent and that the decisions implemented in this direction are consistent.
